6. PUBLIC HEARING ITEM
A. Public Hearing – Discussion and Possible action for a recommendation to City Council regarding the request to Re-Zone a parcel described as a 21.53 acre tract of land in the Robards Texas First Unit from Commercial B-2 District (General Business) and a Pre-Development (unclassified) to an R-2C District (Conventional construction residential); and 100 feet to remain B-2 District (General Business), located at the north corner of O’Connor Road and Miller Road intersection.
Mr. Cox provided the following during staff presentation:
21.53 acre tract of land located at the north corner of O’Connor Road and Miller Road
In September of 2021, the applicant made a request for the entire property to be rezoned at R2-C and was denied.
R-2C is the smallest designation for single family zoning category and is compliant with the surrounding property land uses and zoning.
Council will make the final decision during a regular meeting scheduled for February 22, 2022.
Staff has no objection to the rear property being rezoned R2-C and the frontage of the property remaining B-2 District (General Business).
Jewels Rio – Innovative CRE Realty – 5804 Babcock Road, Ste. 153, San Antonio, Texas 78240 was available to clarify any concerns or comments. She clarified the concern regarding the amount of residential lots the project would lose by having the commercial component on the frontage was 23 homes. Mr. Alfred Hockley – Live Oak Residential, LLC reiterated the example provided during the Joint Public Hearing of a current commercial strip fronting Toepperwein (Brentwood Oaks) in Live Oak to compare the future development’s width. Vice Chairman Kochan stated the option presented to the Board would provide the intent to the mixed use described in the Comprehensive Plan. She noted the concerns regarding the access from the residential to the commercial. Commissioners Kusek had concerns with the project. Alt. Commissioner Llamas asked if a traffic study would be required; Mr. Cox stated a traffic study would be required during the platting process. Commissioners Umphlett and Woppert; and Alt. Commissioner Tremblay had no further comments.
Hearing no further discussion, Chairman Rosenbaum closed by stating the applicant has complied with the changes asked by the Commission and City Council.
