A. P-17-010 – RESIDENCE AT LAKEVIEW-ASPIRE - TREE & LANDSCAPE PLAN - The plan includes a Tree Preservation and Mitigation Plan for the property known as Aspire at Live Oak. The plan includes the preservation and mitigation calculations submitted by Humpreys & Partners Landscape Architecture, LLC. A 13.319 acre tract of land as described on the property of the Francisco Villarreal Survey of the official records of Bexar County, Texas located along the south side of Shin Oak Drive at the intersection of Shin Oak with Oak Terrace.

P-17-008 – RESIDENCE AT LAKEVIEW – ASPIRE AT LIVE OAK REPLAT FINAL – Being a total of 13.319 acres establishing Lots 6-9, Block 42, County Block 5048, area being re-platted are lots 1-5, Block 2, County Block 5048. A Right-of-way dedication of 0.0011 acres and establishing lots 6-9, Block 42, County Block 5048, out of the Francisco Villarreal Survey, Abstract No. 776, Situated within the City of Live Oak, Bexar County, Texas. The property is situated along South side of Shin Oak at the intersection of Shin Oak with Oak Terrace.
Chairman Hovermale read the legal description for the record and asked staff to make presentation.
Ms. Matney provided a brief summary of the previous PUD process for the property establishing lots 6-9 for the multi-family and commercial portions of the project.
Lot 9 is the 9 acres for the apartment complex
Lots 6, 7 and 8 are dedicated to the commercial fronting the access of Loop 1604
City Engineers have reviewed and approved the re-plat
Staff recommends approval and has no objections
Ms. Matney introduced Tony Olfers, Civil Engineers for the project from MBC Engineers.
Q&A
Commissioner Kochan asked if the presented plat was the plat approved by City Public Service (CPS); Mr. Olfers stated the final plat presented has been approved by CPS without changes.
Commissioner Umphlett asked about the entrance location at Loop 1604 for lots 6, 7, and 8; Mr. Olfers stated TXDOT has denied the entrance/driveway being located from Loop 1604. Mr. Olfers added the entrance for the commercial lots fronting Loop 1604 access road will be located on Palisades Drive. Negotiations continue with the owner of the existing Springs Market Shopping Center for a shared access. Should the owner refuse a shared access, the new commercial lots 6, 7, and 8 will have a circulation drive.
Commissioner Umphlett asked for clarification for the entrances to the multi-family complex; Mr. Olfers stated the main entrance would be on Shin Oak Drive and the secondary access would be on the Palisades Drive side of the property.
Chairman Hovermale asked for additional questions; hearing none called for a motion.

P-17-007 - BROOKHAVEN SUBDIVISION PHASE I - FINAL PLAT - A 14.18 Acres or 617,610 square feet of land out of a 42.13 acre tract conveyed to ESE Development, LLC, Recorded in Volume 18184, Pages 1479-1488, of the official Public Records of Bexar County, Being out of the Thomas Barwick Survey NO. 324, Abstract No. 57, County Block 5049, Bexar County, Texas. This property is located near the intersection of Judson Road and Retama Hollow.
Chairman Hovermale read the legal description for the record; and Vice Chairman Johnson recused himself from the procedure due to a conflict of interest with his homestead and P-17-007-Brookhaven Subdivision. Chairman Hovermale asked Alt. Commissioner Kusek to vote in the absence of Vice Chairman Johnson. Chairman Hovermale asked staff to make presentation. Jordan Matney made a brief presentation for the final plat of the Brookhaven Subdivision. She made the following points:
Subdivision formally named Brookhaven will now be known as Vista Ridge
The subdivision has been divided into three phases
Rezoning previously completed on the project
Phase I consist of 14.18 acres of the 42.10 total acres for the subdivision
City Engineer has reviewed and approved Phase I of Vista Ridge
Phase I plans for 68 single family dwellings
Staff has no objection to the approval of Phase I
During the absence of the presenter for P-17-007 due to heavy traffic; Ms. Matney offered to answer any questions from the Commissioners while waiting for his arrival.
Chairman Hovermale asked for questions from the commission.
Q&A Alt. Commissioner Kusek asked if a fence would be erected to divide the Mircom Subdivision with the Brookhaven and at what height; Ms. Matney stated this project being a residential subdivision abutting a separate residential subdivision would only require by code a 6 foot fence. The fence will not exceed 8 foot.
Commissioner Kochan noted a wording correction to be completed and revised under NOTE #1 before filing the plat should it be approved at this meeting. The word “preliminary” was noted instead of “final” plat.
Ms. Matney ensured the correction would be accomplished before filing the plat with Bexar County.
James Eugenio-Presidio Group arrived at 6:17 p.m. to continue the Q&A with the Commissioners. Mr. Eugenio stated the note would be changed. Commissioner Umphlett asked Mr. Eugenio the reason for the name change; Mr. Eugenio stated the builder that will be contracted had a project with a similar name. Vista Ridge will be the official name of the subdivision. Commissioner Umphlett asked for clarification of how many units would be built within the 3 phases total; Mr. Eugenio stated there would be approximately 200 single family homes. Phase I would have 69 units. Phase II would begin in 1 to 1 an half years completing all phases to be completed in 3 years overall. Commissioner Umphlett asked if a retaining wall would be built to divide this subdivision with the neighboring subdivisions; Mr. Eugenio stated there will be small retaining walls built due to the grading but none that would divide or hinder the line of sight from other subdivisions.
Alt. Commissioner Kusek asked the material that would be used on the terraced wall; Mr. Eugenio stated a combination of concrete and stacked limestone.
Mr. Eugenio stated the engineer would delete the incorrect notation in NOTE #1 before recordation.
Hearing no further questions or comments; Chairman Hovermale called for a motion.
