C. Discussion and Possible Action regarding P-19-008 – Live Oak Townhomes – FINAL PLAT - being a total of 1.124 acre Tract of land, known as Avery Subdivision Lots 50, 51, & 52, Block 1, County Block 5049C, City of Live Oak, Bexar County, Texas and as described in Volume 9704, Page 45 of the Deed of Records of Bexar County, Texas. The final plat is for the construction of 11 townhomes at the corner of Toepperwein Road and Avery Road in the city limits of Live Oak, Texas. – M. Hornes
Chairman Johnson read the legal description for Item 6C-P19-008 – Live Oak Townhomes for the official record.
Mr. Hornes announced he would be implementing a GIS plan so the City would be able to present maps via computer rather than large plats during the meeting. Estimated timeframe would be in 2020. Mr. Hornes provided the following points during staff presentation:
- Property is zoned B-2
- Council approved the Townhomes project a Special Use Permit for the construction of Townhomes in a B-2 District
- Variances were granted from BOA-rear setback abutting the residential side and building of eleven lots width less than 30 ft. but the encroachment of the setback on the reverse frontage of Toepperwein Road side was denied.
- A challenge of the property is the detention and is under review by City Public Service (CPS) due to their easement running on the backside of the entire property; owner is still waiting on approval.
- A drainage plan has been accepted by City Engineer’s office, CPS and the City.
- Staff and the City Engineers has no objections to the approval of the final plat for P19-008.
Mr. Hornes closed by inviting Mr. Aaron Dahl with the Radii Group to make the applicant presentation with the following points:
- Owner has been working hard to reach this part of the process for 6 months
- Verified the main challenge of the property had been the CPS easement but together found a solution for the storm water drainage while being able to access their easement.
Mr. Dahl thanked the Commission for their time and offered to answer questions.
Q & A
Commissioner Umphlett asked for clarification on the different sizes within the eleven lots; Mr. Dahl stated the design plans are for the end unit lots to be 24 feet wide which will make the project be in compliance to the Code.
Alt. Commissioner Kusek asked for the number of parking spaces on the backside near the drainage area; Mr. Dahl confirmed there are 24 parking spaced planned but may change to 22 total. It would make six parking spaces per unit, two car garages for each unit, and two parking spaces that abut the rear of each unit.
Commissioner Umphlett asked if the Townhome entrance would be gated for the purpose of Fire personnel access; Mr. Dahl stated CPS may not allow the gate for accessing the easement for maintenance but the gate has been approved by Live Oak Fire Chief Linc Surber. He added the rear of the property would be fenced in accordance with the City’s ordinances.

The property is part of the Vista Ridge Subdivision, Single-Family residential construction project Phase II of three phases.
Chairman Johnson read the legal description for P19-010 – Vista Ridge Phase II-A Preliminary Plat for the official record. Mr. Hornes presented the following staff presentation for Item 6D-P19-010:
