I consulted with Daniel Santee Land Use Attorney for Denton Navarra, City Attorneys regarding the error of the re-plat and preliminary plat being heard within the same meeting.
The re-plat process could be used as the preliminary plat approval and staff could move forward with final plat.
The engineer comments have been corrected and meet both city’s codes more or less (some codes vary)

Mr. Hornes stated the representative for the property, John Gatz with Texas Canyon Consulting was present to answer any follow up questions. Q&A Commissioners Tremblay, Woppert, Woodall, and Vice Chairman Kochan had not comments. Commissioner Kusek confirmed the Monopole tower was the only structure to be erected on the property; Mr. Hornes said it would be a single communications tower and it will be designed to look like a tree like structure to blend in the environment. Commissioner Kusek made a motion to approve Old Austin Road Subdivision P21-005-Final Plat; seconded by Commissioner Bill Umphlett.
Vista Ridge - Phase III – Preliminary Plat for 15.53 acres

This development was allowed to use the City's detention as part of their detention and as part of that agreement, ESE Development agreed to build a park trail connecting the subdivision to Avery Road.
Prior to any work commencing on Phase III, the park project would need to be completed. They would be able to complete the platting process.
City engineer recommends approval of preliminary plat with comments to be corrected before final plat.
Q&A Commissioner Woppert asked for clarification on the exit points; Mr. Hornes stated Micron Drive will be exit point at Weimer Way. A second and third exit is located at Vista Way and Rimwood. Commissioner Kusek asked if the Mircom residents had any concerns; Mr. Hornes stated “no.” Mr. Hornes pointed out the greenbelt that would be the future park which is a walking trail park only with access points for residents.
