A. Public Hearing - P-20-009 – LQMI LIVE OAK SUBDIVISION REPLAT– Receive public comments and testimony for a request to Re-plat a parcel being a total of 3.105 acres being Lots 31 & 32, Block 1 and N.C.B. 16814. The purpose of the re-plat is to create two lots and allow for a 14’ Electric & Gas CPS easement.

1. Staff Presentation – Michael Hornes made the following points during the staff presentation:

This request would normally be an administrative approval by the City Manager; CPS is requiring the property owner to re-plat to include a 20’ CPS utility easement for an existing power line previously not included on the original plat.

The property owners of 12822 IH 35N are requesting to separate the lots of La Quinta Motel and the Denny’s restaurant, creating two lots.

Current Zoning District is B-2-Neighborhood Services District

City Engineer has reviewed the request and have provided approval.

The addition of the underground utility easement and a shared access for the common driveway note is part of the request.

3. Question & Comments from Commission
Commissioner Umphlett asked if the easement would benefit the motel or Denny’s; Mr. Link answered, it would benefit the motel. It’s their existing transformer that was never recorded as an easement. Hearing not further questions or comments from the commission; she called for any proponents or opponents.

4. Comments from Proponents & Opponents – Hearing no proponents or opponents from the audience; Chairman Kochan asked staff to read any comments received via U.S. Postal Service.
