6. NEW BUSINESS
A. Discussion and Possible Action regarding P19-009 – Toepperwein & Miller Subdivision – FINAL PLAT – Being a total of 1.5718 acres of land inclusive of 0.0011 Acre Right-of-way dedication to the City of Live Oak, Texas out of the original 4.985 acre tract out of the Thomas Barwick Survey No. 324, Abstract 57, County Block 5049, Bexar County, Texas. The property is situated on the corner of Toepperwein and Miller Road for the construction of future commercial office space – M. Hornes
Chairman Kochan read the legal description for the official record. She invited Michael Hornes to present the staff presentation for 6A.
Mr. Hornes thanked the Commission and provided the following during the presentation:
- Owner Dr. Boucher will construct a new commercial office for his Dermatology office.
- City Engineer has reviewed the final plat submitted by the applicant and has found it to be in substantial compliance with the City’s requirements.
- Staff has no objections to the approval of the Miller/Toepperwein Final Plat.
Mr. Hornes closed by introducing Mr. Salah Diab with SEDA Engineers and offered to answer questions from the Commission.
Q&A Commissioner Umphlett asked if the final plat was in compliance with the City’s Engineer’s reviews; Mr. Hornes stated all drainage issues were resolved by utilizing the natural flow path that channels into the bridge and naturally flows into the City of Converse.
Commissioner Umphlett asked for clarification on the approved entrances for the property; Mr. Hornes stated they would be allowed an entrance off of Toepperwein and the second entrance off Miller Road. The property address will carry a Toepperwein Road address.
Alt. Commissioner Kusek commented the plan indicated the natural drainage would take up usable property; Mr. Hornes agreed but the owner will be able to construct his building as planned. Alt. Commissioner Kusek also wanted clarification on the natural drainage and the effect on the adjacent lots; Mr. Hornes stated the initial plan for the property platted as one large lot was to subdivide into four lots that would be owned by different owners. The owner of the one lot has moved forward with his project and the remaining 3.5 acre tract remains undeveloped.
Hearing no further questions or comments; Chairman Kochan called for a motion.
B. Presentation and Discussion regarding the 2019 Annual Activity Report for the Planning & Zoning Commission – M. Hornes
Chairman Kochan read the legal description for the official record. Mr. Hornes provided the following during the presentation of the 2019 Annual Planning & Zoning Commission Activity report:
- Provided the total number of plat cases, Special Use Permits, Zoning Cases and variances throughout the period of January 1-December 31, 2019.
- Provided the status of the pending plat cases and attendance records for the members.
- Provided status on construction of major projects such as the Town Center, Skybrook Subdivision, Trumbal Townhomes, Vista Ridge Subdivision and Great Hearts Charter Academy.
- The Comprehensive Plan 2040 will be considered by both the City Council and Planning & Zoning Commissioner during the February 20th Joint Public Hearing.
Mr. Hornes closed the presentation by stating it was a productive year and he looked forward to 2020 being just as productive.
7. GENERAL ANNOUNCEMENTS AND DISCUSSION
A. Commission - City event information, APA Conference follow-up-November 2019, upcoming ribbon cutting/grand opening dates and times and special acknowledgements.
Commissioner Johnson gave a brief overview of the 2019 APA Conference “Big State Big Plans” in Waco, Texas. Topics of interest were Vision Development Urbanism, Mixed Use development and Legislative changes during the 2019 session.
B. Staff – City event information, APA Conference follow-up, upcoming ribbon cutting/grand opening dates and times, APA Conference information-November 2019 and special acknowledgements.
Mr. Hornes invited everyone to the Justice Center on January 24th at 3:00 p.m. for Animal Control Supervisor Terry Phillips for his years of service.
8. ADJOURNMENT I certify that the above notice of meeting was posted on the bulletin board of the City Hall, 8001 Shin Oak Drive, City of Live Oak, Texas, on January 16, 2020 at 5:00 p.m.
