1. CALL TO ORDER - Mayor Mary M. Dennis called the Joint Public Hearing to order at 6:59 p.m.

5. JOINT PUBLIC HEARING ITEM

A. Public Hearing – Z20-001 Toepperwein Medical Office Subdivision - Receive Public Comments and Testimony for a request for Re-Zoning described as a 4.449 acre tract of land for a re-zoning request to rezone the property from an Unclassified Pre-Development District to a B-3 General Business District. The property is known as 12881 N IH 35, Live Oak, Texas 78233.

Mayor Mary M. Dennis read the legal description and opened the public hearing at 7:04 p.m.

1. Staff Presentation - Mr. Hornes provided the following points during staff presentation:

The applicant, Z. Patel, submitted a request for rezoning from Undeveloped/Pre-Developed to a B-3 General Business District.

The applicant is requesting the rezone to make the property more marketable to sell.

The location is also known as 12881 N. IH 35, Live Oak, Texas 78233

The adjacent land use is mostly B-3 with only one section to the north being listed as unclassified.

The request is in line with the surrounding zoning as well as conforms to the City’s comprehensive future land use plan.

Staff has no objections to the re-zoning request.

Hearing no further comments from staff; Mayor Dennis asked for the applicant to provide his presentation.

2. Applicant Presentation - Matthew Trevino with Uriah Real Estate Organization, LLC, representative of the applicant provided the following and offered to answer any questions:

The property is currently up for sale by the owner

The zoning being listed as “un-classified” has been an issue and the problem with selling the property; the owner is asking for the zoning change to make it more marketable for potential buyers.

B-3 will be in line with the city’s land use plan and for the future buyer.

4. Comments from Proponents & Opponents - Mayor Dennis asked Ms. Lowder to read any comments received through U.S. Postal service.

Ms. Lowder stated only one public notice was returned with insufficient address for property owned by Livingway Church. She added that the two other notices for the same owner have not been returned and indicated they both have been received.
Hearing no further proponents, opponents or comments from staff; Mayor Dennis closed the public hearing.

Michael Hornes summarized the public hearing item by stating the following:

The request for rezoning from Undeveloped/Pre-Developed to a B-3 General Business District.

The applicant is requesting the rezone to make the property more marketable to sell and meets our future land use plan.

Staff has no objections to the rezone change request.

Chairman Kochan read the legal description for the official record.

Michael Hornes provided the following during the staff presentation:

The final plat for the original re-plat establishing two lots

The City Engineer has reviewed the final plat and finds it in compliance

Staff has no objections for this request establishing two residential lots out of one.

Edgar Munoz, engineer for the project is available to answer any questions.

Chairman Kochan asked for nominations for Chairman. Commissioner Kusek made a motion to keep Rebecca Kochan as Chairman; seconded by Commissioner Rosenbaum. VOTE FOR: Commissioners Umphlett, Rosenbaum and Kusek; and Alt. Commissioners Woppert, Woodall, Llamas and Nguyen and Vice Chairman Hovermale and Chairman Kochan. – 9/0 PASSED

Chairman Kochan asked for nominations for Vice Chairman.

Commissioner Rosenbaum made a motion to keep Becky Hovermale as Vice Chairman; seconded by Commissioner Kusek. VOTE FOR: Commissioners Umphlett, Rosenbaum and Kusek; and Alt. Commissioners Woppert, Woodall, Llamas and Nguyen and Vice Chairman Hovermale and Chairman Kochan. – 9/0 PASSED Chairman Kochan asked for nominations for Chairman.
