d. Questions and Comments by City Council and Commissioners -
Councilman Dahl asked if the parking ratio had been calculated by the number of bedrooms with the total count; Mr. Johnson stated he had not calculated the ratio by bedrooms. Ms. Matney calculated the spaces per bedroom resulting in 456 spaces and 354 bedrooms. Mr. Dahl concluded it would be a great project and use for the property.
Councilman Cimics concurred the use of the property would be perfect. Mr. Cimics wanted clarification if the 456 spaces included the parking garages; Mr. Johnson answered yes the number included enclosed spaces and carports. Mr. Cimics asked if there would be an additional access from Spring Market; Mr. Johnson stated they were currently working with the owner of the strip mall for cross access until they could reach reciprocal access agreement, the access would be on the Palisades side. Thanked Mr. Johnson for the great presentation.
Councilman Cimics closed by asking if two access points were required on commercial; Councilman Dahl interjected that commercial will not require two access points.
Councilman Brooks needed clarification on why staff was not presenting the amendments as a variance; Ms. Matney stated the PUD would allow for the zoning change and the variances to density, parking and fence or buffing requirements all in one public hearing in lieu of two separate meetings with two separate boards. Councilman asked which of the two segments is higher in elevation and how many accesses would there be for both segments; Mr. Johnson stated Segment 2-Multi-family would be the lower elevation compared to the commercial portion and a total of two access points in segment 2. The main access would be on the Shin Oak side and the secondary would be off of Palisades Drive at the rear of the multi-family development. The commercial portion would have the primary entrance off of Palisades Drive and secondary from be gained through the cross access of the Spring Markets should they receive approval from the property owner.
Councilman Tullgren apologized for arriving late and stated he had no concerns with the request and approved of the presentation package.
Councilman Cimics followed up by asking if the multi-family would be a gated community; Mr. Jonson confirmed it would be gated.
Mayor Dennis asked if the apartment community would include a pool; Mr. Johnson pointed out the location of the pool, pavilion and a dog park as the amenities.
Commissioner Umphlett asked if the commercial portion would have parking lot lights that would affect the multi family; Mr. Johnson answered “no!” Commissioner Umphlett asked Mr. Johnson what type of businesses would be coming to the commercial portion and if there would be a gas station; Mr. Johnson answered there would be merchant/retail type businesses and no gas station.
Ms. Clarissa Rodriguez reminded the members to keep their questions specific to the topic in reference the zoning changes and the amendments the applicant has requested within the PUD only.
Commissioner Umphlett asked for clarification for the height differences in the elevations of the property between commercial and multi-family; Mr. Johnson stated the commercial would be a higher elevation than the multi-family. Commissioner Umphlett asked who owned the land currently; Mr. Johnson stated the David Wieder and his family owned the property.
Ms. Clarissa Rodriguez again reminded Commissioner Umphlett to keep his questions specific to the topic at hand and that he should direct this type of questioning to staff before or after the public hearing.
Vice Chairman Johnson asked Ms. Matney if the Commission chooses to recommend approval to the Council in the regular meeting of the P&Z; the stipulations would need to be clearly mentioned in the motion; Ms. Rodriguez interjected and confirmed the Commission would need to mention all amendments in the motion should they move forward with a recommendation for approval to Council during the regular meeting immediately following the joint public hearing.

Ms. Matney closed by stating staff had no objections to the formal zoning request or any of the amendments made by the applicant, recommended approval, great opportunity for the city and offers an addition to the housing stock in Live Oak.
