• 35.337 acres of vacant land located off of Forest Bluff formally owned by Northeast I.S.D.
• N.E.I.S.D declared the land as surplus approximately a year ago.
• Harden Investments purchased the land and is proposing to build single family homes.
• The current zone is R-1-Single Family District; applicant has made a the request to rezone to an R2-C- Conventional Single Family District
• The difference between the two districts the smaller lot size in a R2-C Most of the property owners that received public notices are in a R2-C district.
• This development will not be a townhome or apartment development
• Woodcrest Park runs behind the proposed development and will not be effected by the housing development. It will remain dedicated park land to include the current walking trails.
• The City is in talks with the developer about improvements to Woodcrest Parks' off site detention.
• The lot depth and width for the development would be 50' x 100' versus 60' x 120' in an R-1
• Lot size comparison would be 5,000 sq. ft. for R-2C versus 7,200 sq. ft. in an R-1

Ms. Matney closed by inviting the developer of the property to approach the podium.

• Live Oak is a great location
• The decision to select the site was based upon the “look and feel” of the surrounding neighborhoods
• Harden Investments Corporation has been in business for a year but in the construction business for over 20 years.
• The goal is to develop the 147 lots
• Lots would be 50’ x 120’
• The street layout will consist of a loop around the perimeter of the development and a street cutting through the center.

• SU-19-002 permit is to allow hail shade ports in a B-3 zoning classification.
• a Variance request for hail shade ports in the front setback that is not include in this Specific Use request was pulled by the applicant which would have been heard by the BOA.
• Existing SUP #SU-07-02 for this property had a layout specific and does not allow for the proposed number of ports requested.
• New SUP will allow for a better configuration to meet the needs of the dealership
• 200 feet public notices were mailed to property owners
• During the Planning & Zoning regular meeting, the Commission will make a motion to make a recommendation on the item to the City Council.
• Council will make the final ruling at their March 26th regular meeting.

• Visibility issues were created on the configuration on the variance previously submitted layout.
• The new layout should has corrected any visibility issues.
• Owners wanted a product that Live Oak would approve

Chairman Johnson stated the small office building has always been in the parking lot. He also asked if they would use the same anchors at the base; Mr. Thomas stated it would all be new construction.

• This item has been discussed at length in recent City Council & Planning & Zoning Commission meetings
• The proposed changes to the ordinance would allow for carports up to 5 feet from the property line in all residential zoning districts in the City.
• Staff has added language in Exhibit 1 to help further clarify to property owners the distance at which their carports may be built. (SEE EXHIBIT BELOW)

1. Guadalupe Carbejal - 7719 Avery – Opposed – Causing parking in the street issues
2. Thomas Obrien-13000 Welcome – In Favor – owns Covenant Works Construction & builds carport structures; agrees with staff about the confusing language. He currently has 15-20 customers/residents that would like to have a carport but the current ordinance would not allow the carports on the property.
3.  Ken Bramble - 11211 Forest Night – Neutral – ask the Council to do their due diligence before making a decision. The language needs to be addressed in the current ordinance.

Mayor Dennis read the prepared statement from Councilman Morgan during his absence. (See Attached email)

Councilman Dahl read his prepared statement on the matter. (See attached correspondent)

 Councilman Cimics commented that he was pleased with the new language making the ordinance easier to understand.

Vice Chairman Kochan wanted clarification about storing items under the carport; Ms. Matney stated storage underneath the carport would be prohibited unless it is an item that is made for outside, i.e. a patio chair. Vice Chairman Kochan also wanted clarification if all residential districts would be included in the carport ordinance; Ms. Matney stated that all residential districts would be included. Each district would have a different setback measurement to abide by. HOA would also regulate some of the residential districts and forbid the construction of such structure.

Chairman Johnson commented that most of the safety issues discussed are due to blocking the view of sight with larger vehicles.

Councilman Tullgren commented that he appreciated everyone’s time and stated he did not see a carport would be considered as a safety issue, it would be the vehicles parked underneath that may cause a line of sight issue. He closed by saying he was in favor of carports with the new verbiage.

Hearing no further questions or comments, Mayor Dennis closed the public hearing for item 4C.

• Staff received a request for a daycare business to open within a B-2 Neighborhood Service District and in the current Schedule of uses, there is no mechanism to allow it.
• Daycares are currently allowed in a B-1 and a B-3 Business district.
• Staff feels that not only should a daycare be allowed in a B-2 zoning category, but that the proposed daycare facility is a good fit for the planned location.
• Revision is a minor revision and will allow a business to succeed in the city.
• Public notice was placed in the Northeast Herald
• Planning & Zoning Commission will convene for their regular meeting to make a recommendation to City Council.
• City Council will make the final determination at their next regular meeting, Tuesday, March 26, 2019.
