A. SU-19-003 – The applicant, Radii Group, LLC, has submitted the request for a parcel being a total of 1.124 acre Tract of land, known as Avery Subdivision Lots 50, 51, & 52, Block 1, County Block 5049C, City of Live Oak, Bexar County, Texas and as described in Volume 9704, Page 45 of the Deed of Records of Bexar County, Texas. The applicant is requesting the Specific Use Permit for the construction of 11 townhomes in the zoning classification area of B-2 General Business District in the Zoning Ordinance; and permission to construct 3 stories in accordance with a B-2; and permission for lots widths to be a minimum of 22’-8”, and side yard setback (Reverse Frontage) is permitted to encroach no more than 3’ into the required 25’ setback with a rear setback of no less than 20’ provided such rear yard abuts common parcel of development.

Chairman Johnson asked Alt. Commissioners Rosenbaum and Woodall to vote during the proceedings since Vice Chairman Kochan and

Commissioner Hovermale were absent during the preliminary plat of Item 6D in May.

Mr. Hornes made the staff presentation with the following points:

Harden Investment Group is present tonight to answer any final questions

City Engineer has reviewed the changes for final plat and submitted for final approval

Staff has no objection to the Skybrook approval

Mr. Hornes introduced Jack Harden with Harden Investments.

Since preliminary in May, Harden Investments Group finalized the purchased on the 35 acre property

148 Home sites are planned in the Skybrook Subdivision

2 entrances off Forest Bluff

60ft ROW at the entrance and interior streets will have 50ft ROW

5 new streets

R2-C Zoned with 50x120 average size lots

Detention on sight

8 foot drainage easement owned and maintained by the HOA

Walking trails on 6/10 of an acre will be dedicated to the City and will connect to the Woodcrest walking trail.

Chairman Johnson stated a change should be made to the General Notes section referring to the “alignment will be finalized” on final plat. Language needs to be changed before filing the plat.

He continued by stating there is a page numbering discrepancy that should be corrected before filing the plat.

Q&A Commissioner Umphlett asked for clarification on the CPS notes and whether they had approved the final plats; Mr. Harden stated CPS had submitted preliminary approval and will again review the infrastructure plans for the subdivision during the civil plan review.

Hearing no further questions or comments; Chairman Johnson called for a motion on item 6D.

Commissioner Glowacz made a motion to approve the final plat for Skybrook Subdivision contingent on all changes and spelling errors are corrected; seconded by Commissioner Hovermale.

VOTE FOR: Alternate Commissioners Rosenbaum and Woodall; and Commissioners Umphlett, Glowacz and Hovermale; and Chairman Johnson. 6/0 PASSED

Discussion and Possible Action regarding P-19-007 – Valderaz Subdivision – PRELIMINARY PLAT – Being a total of 0.578 acre tract of land described in The Francisco Villarreal Survey, No. 309, Abstract No. 776, City of Live Oak, Bexar County, Texas. Recorded in Volume 16604, Page 876, and official Public Records of Bexar County, Texas. The property is situated at the corner of Narrow Pass and Toepperwein Road for a proposed commercial business office.

Chairman Johnson read the legal description for the official record.
Mr. Hornes provided staff presentation for the Valderaz Subdivison with the following points:

0.578 acres tract located at the corner of Narrow Pass and Toepperwein Road

Property is designated for the construction of the a commercial office building

Final plat is scheduled for July 23, 2019

City Engineer’s office has reviewed and approved the preliminary plat

A few additional changes need to be made by final plat review

Setback lines located on Narrow Pass will need to be corrected and listed as 25’ as this is a reverse frontage lot.

1 foot non-access easement will be added along Toepperwein ROW

Based on the minor nature of the corrections, staff has no objections with the preliminary plat approval.

Mr. Hornes introduced owner Dr. Manu Valderaz and Jose Villagomez Civil Engineer for the project.

Dr. Manu stated the commercial building would be constructed as an Optometry facility for his practice and a portion will be a leased space.

Q&A
Commissioner Umphlett asked Mr. Villagomez asked for clarification on the comment referencing the reverse frontage; Mr. Villagomez stated the plans have been updated to reflect the setback lines on Narrow Pass.

Preliminary Plat for 4.831 acres

City Engineer has completed a review for the preliminary with comments and correction for final possibly in July.

Property will be used for future office space

Staff has no objections to the approval for preliminary plat

Mr. Hornes introduced Salah E. Diab with Seda Consulting Engineers representing the owner, Mohssen Afsous.

Mr. Diab made the following presentation for Item 6F:

Seda Engineers are currently correcting all comments and corrections received from Don McCrary’s office.

The property will accommodate a future office/medical facility

Mr. McNew addressed the following issues:

Drainage channel on the property poses some difficulties

Drainage easement containing the storm water runoff from the culvert under Toepperwein must be added across Lots 5 & 6.

Drainage detail calculations showing the flow that is contained within the easement must be provided.

Conversations about the Sidewalk issues on the Toepperwein side have occurred

Mr. Diab is working on the issues mentioned in the engineer’s review and McCrary’s office will approve the current submission for preliminary.

Q&A
Alt. Commissioner Kusek asked how long the sidewalk issue has been discussed on that portion of Toepperwein; City Manager Scott Wayman interjected that the City could wind the sidewalk around the area with a bridge but would be very costly to everyone involved.
